Lessee further acknowledges that lessee have had proper instruction to use the equipment leased and is properly qualified to use said equipment and agrees to assume complete and sole responsibility for said use and forever holds Big Island Divers free and harmless for anything occurring as a result of said use. Lessee further agrees to accept full responsibility for any injury either to themselves or to any other persons that may result through the use or misuse of the leased equipment, or in any manner whatsoever, from the time the equipment leaves Big Island Diver’s premises until it is returned thereto. Lessee further agree that said equipment will not be leased to any other person than the undersigned lessee without first obtaining permission from Big Island Divers with prior consent in writing. Lessee further agrees to keep said equipment from all encumbrances and for failure to do so or for default of any of the terms and conditions hereof, Big Island Divers staff may take immediate possession of said equipment whenever said equipment may be found, without being liable for trespass, and that such repossession shall not relieve lessee of his/her liabilities under this agreement. Lessee agrees to pay the amount of $25 per rental that has not been properly rinsed of sand, salt water or any other foreign material that may harm the condition of the gear as mentioned in the first clause. Lessee agrees to pay 100% replacement cost for damaged or lost Lefeet S1 Pro Scooter, Lefeet Backpack, Lefeet Floating Fin, amd Lefeet S1 Pro Extra Battery. Lessee acknowledges that lessee has read the terms of this rental agreement and fully understands and consents to all of the provisions thereof. Lessee agrees that in the event any legal action is instituted against lessee under this agreement by Big Island Divers, they will pay reasonable attorney’s fees and costs incurred in such action.
