Annual Commercial Service Agreement

By signing this Annual Service Agreement, the Commercial Account (herein referred to as “the Account”) authorizes Horizons Pacific Inc DBA Big Island Divers (BID) to perform necessary maintenance, testing, and repair services on any equipment presented by the Account within a one-year period from July 27, 2026.

This agreement serves as a standing authorization for all equipment brought to BID by the Account throughout the year, which commonly includes, but is not limited to: cylinder visual inspections, tank valve service and repair, and regulator servicing. Equipment brought to BID for repair or service should have extraneous accessories removed. This includes items like knives, safety tubes, weights, clips, etc. BID is not responsible for any item not removed.

1. Scope of Pricing and Services The Account recognizes that all quoted prices cover labor and service only. The cost of replacement parts—including, but not limited to, hoses, mouthpieces, and batteries—is not included in the initial service quote and will be added to the final invoice. If an item has become obsolete or if the cost of service would be prohibitively expensive, BID will contact The Account before any work is done. The Account agrees to pay all costs associated with equipment submitted for repair or service within the contract period. BID reserves the right to refuse service on any equipment deemed unsafe to operate.

2. Equipment Pickup and Forfeiture Policy The Account will be notified immediately upon the completion of services. All serviced items must be retrieved within ninety (90) days of notification. Items left at BID for more than 90 days will be considered abandoned and will be forfeited to BID.

3. Cylinder Inspection Standards The Account authorizes BID to conspicuously disable any compressed gas cylinder accepted for visual inspection that fails to meet standards published by PSI-PCI (Professional SCUBA Inspectors – Professional Cylinder Inspectors). In the event of an inspection failure, the Account will receive a written report identifying the specific reason(s) for the failure, and the disabled cylinder—along with all associated components—will be returned to the Account.

4. Safety and Inspection Warranties The Account agrees to thoroughly inspect and test all serviced equipment for safety and proper operation prior to every dive.

5. Limitation of Liability and Waiver Should BID be found liable for any injuries, damages, or losses resulting from a failure to perform its obligations, or from a failure of the equipment to operate properly, BID’s total liability shall be strictly limited to a sum equal to the amount paid to BID for the specific services rendered. This liability cap is exclusive and applies equally to equipment that is lost or damaged while in BID’s possession.

The Account acknowledges, recognizes, and assumes all risks inherent in the sport of scuba diving and the use of scuba diving equipment. By signing below, the Account waives any and all claims for injuries, damages, or losses—including claims of negligence—against BID and its employees, instructors, agents, and representatives arising out of services performed or omitted under this Agreement.

This Agreement shall be legally binding upon the Account and its legal representatives.
